Welcome to Ballers App provided to you by SA Fotboll AB, registration number 559202-1751 (“SA Fotboll”, “we” or “us”).

By using Ballers App, the user or partner agrees to these Terms of Use. Please read the following Terms of Use carefully before using the Services (as defined below). If you do not agree to the terms of use, do not use the Services. These Terms of Use apply to the use of the Services and to any agreement between a partner and the user with regard to the Services. If you register as a manager, scout, player or other legal entity, you represent and warrant that you are authorized to bind such natural or legal person to these Terms of Use.

1. Definitions

“Partner” means a user, trademark or similar body that has entered into an agreement with us and offers its content, experience and brand affiliation to benefit players, coaches or the football landscape through the Services.

“Partner Representative” means any natural or legal person who is legally required to represent the partner when entering into an agreement.

“Ballers App” means Ballers App and any other digital application provided by SA Fotboll for natural and legal persons to create a football profile or presence by uploading content, results and performance inputs either as users or partners.

“Services” means both the App and our website ballersapp.com and other additional sites mentioned on ballersapp.com.

“User Content” means anything that is published by a user or made available through the Services by the user.

2. Description and purpose of the Services

2.1. SA Fotboll acts as an intermediary between the user and Partners and provides a platform for the user to upload results, content and feedback as well as interact with the community of users and Partners.

2.2 In exchange, the Partners provide information on exclusive offers, news, content, special events, trial and scout opportunities through the Services.

2.3 A user can create a profile as either a player, a coach or a scout depending on their involvement in football where they will then enter relevant information.

2.4 The purpose of providing us with this information is to help users track and develop their football career or others’ careers. The user data is used by us to analyze the youth football industry as a whole and to connect users to the football opportunities that may best apply to them. This may include, but is not limited to, partnering, discovery events, training, deep learning or special events.

3. User accounts

3.1 In order to use the Services, the user must create a user account by following the registration instructions in the Services. The Services are personal. The user shall ensure that all user account information and corresponding information required to access the user’s user account is kept confidential and used in a secure manner that is not available by third parties. A user can only have one user account.

3.2 If it is suspected that any unauthorized person has become aware of the user’s authorization details for its user account or otherwise has gained access to the user’s user account, the user shall immediately inform Self Made Academy of this. The user is responsible for all use of the Services and all activities through and on its user account.

3.3 To use the Services, the user must provide valid and accurate results and data to the best of its ability. The user agrees to abide by these rules. The user is responsible for keeping the information up to date and accurate in order to benefit from any profiling or celebrations from Partners or from us.

3.4 If a user does not comply with these Terms of Use, we may in our discretion use our choice to delete that account. If a user chooses an identifier for its account or team page, we reserve the right to edit, delete or retrieve it if we deem it inappropriate (such as a username or team name that does not have a close related to the user’s actual name, club or level).

4. Data

4.1 The purpose of using the user’s data will be in the spirit of benefiting from youth football as a whole, and the user itself where possible.

4.2 We will request data that is closely linked to 2.4 and minimize excessive data collection.

4.3 The usage is on the user to ensure that their data is up to date and correct via their inputs. From this, we will ensure that the stored information is accurate and up to date.

4.4 We shall store the information about users for an unlimited period of time. This is to monitor the development over time, as well as to follow the trends in youth football as a whole. If the user does not agree with this, they can request that their account be deleted.

4.5 We will take all reasonable steps to ensure that personal data is kept secure – against both external and internal threats.

4.6 The information provided by users to the Services may be accessed directly by third party providers. This information will not be made anonymous, and may be hosted on a third-party provider’s server.

4.7 Further, the user may at any time request that a complete set of their data from us. In this case, the user should send the request via email to in**@se*************.se The company will provide the information to the user within a reasonable period of time.

5. Recognize talent

5.1 By using the Services, the user agrees to share their information with applicable partners to be profiled, sponsored, scouted or to receive special offers or opportunities.

5.2 With this agreement, the user also accepts that the Services can only highlight players or coaches on which we have specific data. This means that the user is on the user to make sure their profile is up to date and correct.

5.3 According to us, the opportunities that are created to highlight talent are fully assessed. We may take into account user data, social tracking, content, coach feedback or other measures to assess talent.

5.4 We have developed its own algorithms to gain talent. These algorithms can be adapted and developed over time to ensure that this remains an accurate measure of talent.

6. User generated content

6.1 Users may publish, save, upload and / or contribute (“post”) content to the Services, including images, text and results (goals, assists, substitutions, cards or similar inputs).

6.2 Users retain all rights in and are solely responsible for the User Content published at the Services.

6.3 When publishing User Content on the Services, we are granted a non-exclusive, transferable, part-licensable, royalty-free, worldwide license to use any User Content that you publish on or in connection with Services.

6.4 This license applies during the user’s period of having a user account or deleting User Content. This does not take into account User Content shared by others, including but not limited to partners and us.

6.5 We and our affiliates may retain and continue to use, store, display, reproduce, repost, modify, execute and distribute any of your User Content that other users have stored or shared through the Services. In addition, deleted content can remain in backups for a reasonable amount of time (but not available to others).

6.6 We are not responsible for any User Content and does not endorse any opinion on the User Content. We reserve the right to remove and modify User Content for any reason including User Content which we believe violates these Terms of Use.

6.7 We value ​​feedback from users and Partners, and we are always interested in learning how to improve and make the Services better. If users or Partners submit comments, ideas or feedback, you understand that we are free to use them without any limitation or compensation. However, we are not obligated to use comments, ideas or feedback, just as you have no obligation to offer them.

6.8 You have sole responsibility for accuracy, quality, integrity, legality, reliability, suitability and intellectual property or the right to use any uploaded information you submit. We are not responsible or responsible for deletion, correction, destruction, damage, loss or failure to store uploaded information. We may attempt to recover lost data, but we provide no guarantees to recover or recover lost data.

6.9 There is no tolerance for offensive content or abusive users. If a user is acting this way, their account will be suspended with immediate effect.

7. Intellectual property rights

7.1 All intellectual property rights in or related to the Services and related documentation and all parts and copies thereof shall remain exclusively owned and be our sole and exclusive property and / or its subcontractors / licensors. Intellectual property rights include copyright and related rights (including database and directory rights and photographic rights), patents, tool models, design rights, trademarks, trade names, trade secrets, know-how and other forms of registered or unregistered intellectual property rights.

7.2 These Terms of Use do not grant the user any intellectual property rights in the Services and all rights not expressly granted herein are reserved by us and our subcontractors / licensors.

8. Additional rules for using the Services

8.1 Persons under the age of 16 need the consent of their parents to use Ballers App.

8.2 The user or Partner must comply with all applicable rules and regulations when using the Services, including content creation or customization.

8.3 We are constantly developing the Services and we may change or remove various parts of the Services, including features, products and partners available in the Services in whole or in part.

8.4. By using the Services, the user or Partner may encounter content or information that may be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. We try to review all content provided by partners. We are not responsible for the content or information of third parties (including partners) or for any damages arising out of the use or reliance on it.

8.5 Users and Partners are responsible for procuring and maintaining all devices or equipment (such as mobile phones) and connections necessary for accessing and using the Services and all fees related thereto.

8.6 The user or Partner will not:

(i) use or attempt to use another person’s user account and / or access another person’s performance data on the Services or use another person’s input data when using the Services, without the consent of the other person;

(ii) copy, modify or create derivative works of the Services or other related technology;

(iii) copy, disassemble, decipher or otherwise attempt to derive the source code for the Services or other related technology or any part thereof;

(iv) delete any copyright, trademark or other proprietary notices contained in or on the Services;

(iv) remove, cover or hide advertisements that are part of the Services;

(v) collect, use, copy or transmit any information obtained from the Services without our consent;

(vi) use bots or other automated methods to use the Services;

(vii) create a user account with a false identity or identity; and

(viii) access the Services except through the interfaces expressly provided by us, such as the Ballers App and our website.

8.7 SA Fotboll will process all personal data collected from the user in accordance with our privacy policy.

9. Termination period

9.1 These Terms of Use shall remain as a binding agreement until further notice as long as the user or
Partner uses the Services.

9.2 The user or Partner may discontinue use of the Services at any time. SA Fotboll may stop providing the Services permanently or temporarily at any time.

10. Limitation of Liability

The following sections apply only to users who do not use the consumer of the Services. Under no circumstances shall SA Fotboll be liable to the user for indirect damages, including lost profits, lost sales or business, lost data or business interruption or for direct damages resulting from third party agreements between users and Partners.

11. Complaints

11.1 Please note that the Services may be canceled or permanently closed at any time. The Services can also be temporarily suspended. Do not use the Services to back up your data.

11.2 The Partner is solely responsible for any misuse of data on their members’ behalf, based on their agreement.

12. Applicable law, dispute resolution and governing language

12.1 These Terms of Use are governed by and shall be construed in accordance with the laws of Sweden. If you are a consumer resident in the EU, you should note that you cannot be deprived of the rights granted to you by the mandatory consumer protection laws in your place of residence. Disputes arising from these Terms of Use shall be resolved by the District Court in Stockholm. A consumer can always bring an action before the court of the court. The parties can also use the ODR platform managed by the European Commission to resolve their disputes. This platform is available at http://ec.europa.eu/odr.

12.2 In interpreting these terms, the English version will be considered decisive and binding.

13. Changes

13.1 These Terms of Use are subject to change.

13.2 We shall publish the modified Terms of Service on the Services and/or our website and shall inform the user and Partners that the Terms of Use have been changed on the Services or via email to that email address sent to the Services by the user or by the Partner. If the user or Partner does not agree to any changed Terms of Use, this entity, whether natural or legal, shall discontinue use of the Services.

14. Assignment

14.1 SA Fotboll has the right to assign all or any of its rights or obligations thereunder in whole or in part to a subsidiary or successor or to a buyer or acquirer of its business assets related to Services without the user’s or Partner’s prior approval.

14.2 The user or Partner is not entitled to assign any of its rights or obligations under this in whole or in part.
